that's my two cents worth. have a great night. thank you for joining us. have a great evening. we'll see you tomorrow. ♪ lou: good evening, everybody, and thank you for joining us. the state of connecticut and the unit the nations today furthering assault on the second amendment. a bipartisan group of connecticut lawmakers drafted a proposal that would be one of the toughest gun laws in the nation if it is signed into law. the united nations overwhelmingly approving the global arms trade treaty, and international agreement that threatens the second amendment rights of all american citizens. we begin tonight in connecticut where the draft legislation would add more than 100 types of guns to the state's list of banned so-called assault weapons. it would limit the capacity of

magazines to ten rounds. law-abiding owners of the newly bannedded give ups and magazines would be forced to register the equipment with the state of connecticut. that proposal calls for universal background checks for all weapon sales while creating the nation's first statewide dangerous weapon offender's registry. at the united nations, the global arms trade treaty passed calling for all nations involved to keep records of all arms transfers and suggests these records include information of end user ors private owners or as we call them in this country, citizens. the records would be kept in what the united nations calls, a, quote, international secretary yat, sparking fears that information on american gun owners would be publicly available around the world. congressional republicans have vowed to block ratification.

meanwhile, congresswoman of new york pushes congress to pass a bill to require gun owners to buy insurance policy or face a $10,000 fine. similar proposals have failed in the states of california, connecticut, maryland, massachusetts, new york, and illinois, all traditionally left leaning states. also, here tonight, the dow jones industrial average and s&p 500 moving to record highs. wall street veteran joining us to give us an analysis of how high the market will go, one of the country's leading hedge fund executives. a bomb shell in the case today as well. the wrongful death trial of michael jackson picking up today, and its deadline day for 35 teachers who have been indicted in the atlanta cheating scandal. they turned themselves in today. dobbs law taking on the cases

with the attorneys, and senate judiciary committee out of the goodness and graciousness of his heart offers to consider one public hearing on comprehensive immigration reform. perhaps one. as the associated press removed the term "illegal immigrant" from their style book, we have the dobbs forum to talk about what lies ahead in immigration reform. the national rifle association today remains the only organization with the viable plan to protect our children in school. the organization released its nra national school shield initiative recommending sending trained armed officers to every school in the country. fox news, congressional correspondent with our report. >> three and a half months after the newtown, connecticut tragedy, the nra, the nation's largest gun organization,

reelection in 20 # 14. it's not clear if senate leadership passes it watered down or try to do something ambitious and blame the republicans if it fails. lou? lou: all right, thank you very much, mike. fox news chief congressional correspondent. north korea saying it will restart a plutonium reactor, increase production of nuclear weapons material, and secretary of state john kerry vows the united states will defend itself following a meeting with south korea's foreign minister. >> we've heard an extraordinary amount of unacceptable rhetoric from the north korean government in the last days. let me be perfectly clear here today. the united states will defend and protect ourselves and our treaty ally, the republic of korea. lou: the secretary of state's comments confirms its move to second warship to the korean peninsula. joining us now, former pentagon

official, fox news national security analyst, and joining as well, retired u.s. army general and former commander of the first infantry division, a combat veteran, seeing action in vietnam, gray that da, yugoslavia, and iraq. thank you for being with us, general. the secretary of state meeting with the foreign minister in south korea saying clearly as he did that this is it. there's no more gains from at least the united states side, is that a correct inference? >> i'm not sure what it means, but the biggest problem with the north korea thing is it's new. that they doo it every year. they have a crisis, we get nervous, go to the table, give them aid, and everything is fine until next year when they have a new crisis. the reason it's different this time, though, is because there's new leaders in north creigh, ya south korea, japan, china, and

other than the americans, the other guys are all hot, so it's not clear, they have not danced before. do they know when to start and stop? that's the biggest concern, plus, the fact that the north korean leader, he shouldn't be allowed to play with matches, and he's about to get hands on nuke lap weapons. lou: general, you have been stationed in korea and know the region and res here. what is your take on where we are right now, and what is a building confrontation with a very young new leader of north korea. >> well, lou, a dangerous leer, and it's been for over 60 years, the same set of crazy leaders in north korea. one thing that was not changed are the gi's on the militarized zone up in the dmz, and the families, korean, u.s., other

allies within rocket artillery range in seoul, korea, right to the capitol. there's little time to reagent to crazy action by north korea. they are powerful with rocket artillery and special operationing forces, dug in like rats throughout the mountain side. it's a tough foe. there's a lot of rhetoric, but you have to be on top of the game just in case. lou: those forces, our 35,000 troops, i sit here last night, it's time to get them out. we don't need to expose 35,000 of our troops to the prospect of injury or death as a trigger point to understand that the north koreans are serious. they are exposed mightily. why in the world are we continues to leave troops in that position, and why are we not, instead of exposing pilots

and troops to the enemy, why are we similarly saying if you cross this line, icbms will be falling on your head? >> a couple reasons. they were there as a trip wire, intentional trip wire to say to the north creep, you mess with south korea, come to us first. i agree. we should have reconsidered our position in the koreas a long time ago. why we have 30,000 there as a trip wire that within a minute a missile goes from north korea to south korea. lou: i don't understand, general. you were one of the trip wires at one time. i mean, i don't like the idea of describing an american service member as a trip wire in any regard, but i certainly don't want to see them raid, you know, 35,000 of our troops lining up against a million man army of the north koreans. what sense does that make?

>> it's a difficult set, no doubt about it, and i agree, you don't want to be called a trip wire. you have the feeling because, you're right there, and when they start, it's going to be fast and furious, but having american gis there is not a deterrent, no doubt about it, and because of there, there's commitment or better be commitment of the united states of america to unlerp hell op the enemy if that happens. when you're a gi, you sign up for that. that's part of being a soldier. it's tough to be that close, stay on top of your game. there's been adjustments made in 60 years on the disposition of troops, but it is a dangerous position to be in. i'm not sure you can pull out. i don't know that i agree with that. lou: okay. that's why you are here. to offer me better council. with china mobilizing in the northeast part of the country, a

rising number of forces including its air force, this is a very difficult challenge indeed. we've flown two b52s, or the pentagon let us know there's been two flights. there have been two b2 flights or two f22 rap dorees now, two more warships. it is, we're going, apparently into the region by twos. is that an adequate and justified response in your view, general grange? >> well those are powerful platforms and get the attention of the enemy, but you have to have a land, sea, and air set, you can't rely on just one dimension of power to detour or respond to an attack. don't get me wrong, with a small number of troops, small platforms over there, it doesn't mean you're not going to do horrific damage to the enemy. i mean, we know how to do that, and that would happen

immediately. no doubt in my mind. if it didn't, i would be ashamed of our nation, but i believe that that's just the front end of very powerful response. lou: kt, you get the last word on this. >> i think it's time to go to china and tell them, look, the calculation changed. you have as much to worry about as a militarized northeast asia as we do. we don't want japan or korea to collapse. how will you help us diffuse this and give the guy a way to get off the platform? lou: at what point does it become tiresome for the united states and our officials to go hat and hand to beijing whether it is on the trade policies, whether it is on their posture in the middle east, whether it is north korea. >> yeah. >> to continue to ask of them rather than the united states to create and execute strategies

lou: stocks at an all-time high, once again. fortune's investment group here to offer insight on the market and its considerable insight, but before we talk with him, let's look at what happened on wall street today. fannie mae turning a record $17 billion profit last year. auto makers with the best month in years. how are we doing so far? stocks at record closing highs. dow up 89 points, the new high 14662.01. the s&p 500 up eight points pushing the broad market index to a new all-time high, 1570.25. nasdaq up 15 and two-thirds, far from the closing high we don't think about it. volume 2 #.3 billion shares on the big board, and stock of iec up almost 3 #% after a federal appellate court rejected a request from broadcasters and

owners to halt the companies' tv over the web service. barry runs iac, and he is celebrating, i'm sure, in his quiet and pleasant way. in the commodity market, gold dropped $25 an ops. oil up 12 cents a barrel, and in the debt market, yield on the treasure's tennier 1.86%. the next guest says the economy grows despite the government as stocks continued this record run. joining us now, mike, principle of portraits investment group. good to have you here. >> thank you, lou. lou: mike, this market, it's unrelenting, just, what is driving the market? >> you know, it's interesting. the old add damage, don't fight the fed, is at work here. it's not just the fed. it's the fed, it's the ecb, and the boj, a global e quitty push. look at the underlying part of the market is you get multiple expansion. the growth side is not doing

great. it's defensive, dividend stocks, and globally, people put money to work, what the fed wants them to do, take risk. lou: we've got a number of shorts out there pushing hard, talking about, you know, 12 mc% unemployment in the eurozone. talking about this -- fifth year of the tired old bull market. things have got to drop, and the only question is by how much? 20%? 10% your thoughts. >> last year, we had event risks, existential crisis in europe, the legs in the u.s., and so you had this tail risk in the market. it doesn't exist this year. two minor runs, italian elections and cypress crisis. they have come and gone and will be solved. there's not a lot of big events out there. lou: what do you see the rest of the year? >> i literally see markets don't go straight up forever so there's some corrections, but broadly thinking, take out the highs, usually when markets take out highs, there's another leg

in. i could see in the next six to 12 weeks another 10% rally in the s&p and associated markets. the economy is growing. the -- lou: not as fast as we'd like, but it's growing. >> there's a drag from the government. it's known, priced in the market, but you got auto sales doing fine, the construction industry and the housing industry really making a comeback, which is big, the tech business continues to do fine, and the energy, do not underestimate the energy revolution providing it's cheaper energy and jobs. put that all together, it's a decent two and a half% or 3% growth rate. lou: which most a year ago would have signed up for in a second. well, i want to turn to something else you are figging for, and i think most americans probably are not aware of it, but the fact is mike is a former wrestler himself. you may encyst you still will.

♪ lou: in the "chalk talk" tonight to our wednesday blues state confrontation, if you well. the wall street journal wrote -- journal reporting that only 14 of the country's 100, 14 out of 100 of the country's largest cities have more jobs now than before the recession. that is extrrordinary. we have always to go, don't we? we have laid out those cities for you here. do you know what? this is pretty amazing. six of those cities are in the red state of texas. they are austin, san antonio. let's just checked these as we go. i don't know if you can tell, but that is supposed to be read.

austin, san antonio, el paso, mccallum, dallas, texas. houston. pretty impressive. what about the rest? amok, nebraska, oklahoma city, salt lake city, pittsburgh, knox will come in charleston. every once in awhile you have a blue state that gets it right. democrats sweating this one. san jose california is in there. we have that to work with. san as a californian estate with a democratic governor, that is kind of exciting. made the list. we are giving that to the border states. meanwhile, also reports that a growing number of states are ending this fiscal year with not deficits -- it's hard to imagine, but with surpluses. among them, of course, is the state of texas. taxes -- texas is projecting an

almost $9 billion surplus. it has a republican governor. a fellow by the name of rick perry. north dakota is projecting over one-half billion dollars surplus . energy independence. north dakota has a republican governor. ohio is expecting a billion dollars surplus from the current fiscal year. it has a republican governor. wisconsin, a very famous republican governor projecting almost half billion dollar budget surplus. governor scott walker. i will projecting and $800 million surplus and, yes, another republican governor, tennessee, little over half a billion dollar surplus. in the state of tennessee, well, florida, not quite half, four under and $37 million in surplus again. a republican governor.

i just want to us here at a shout out, if i may, to the state of california, the only blue stayed on track to end the year, are you ready, with a surplus. it is only $36 million. you know what? us surplus is a surplus, and the state auditor says california has a negative net worth. you know what to my-net worth to 127 billion in california. i know it is only a $36 million surplus. you know, you have to give him credit for trying. they tried. they get an actual surplus. as you can see, that is not working and so well for fiscal responsibility and job creation, is it? i think the reds states are more than just a little ahead. but the point? border security, absolutely essential to the immigration

the couple, yes. absolutely. >> racketeering. lou: racketeering. to prosecutors and one of the district attorney's wife murdered in texas. they have been talking about it as the aryan brother read. now we are hearing it is the book cartels. a lot of people are understandably scared right now. the question is, the authorities also intended? corruption is not just on the southern side of the border. there's too much money for it. >> district attorney's gunned down. absolutely. will they keep doing their job? of course. a horrible fact of life that prosecutors could kill then threatened more often than we like to think about. >> defense attorneys, but we may never solve it.

it is a mystery that may never be solved. lou: you know what else is scary. they have a sheriff's deputy protecting a district attorney and his wife. the pullout just a matter of days before this occurred. a lot of bad judgment remained, but we don't know what is going on. the fbi is now again. what i don't hear it is the justice department making this a big deal. i don't understand why the justice department is not sending attorneys and everyone making a perrin's on in there. >> i'll give you a personal experience. the department of justice was on that case. it is still unsolved. all these years later. this of the department that is all these people do. >> every dat in the entire

united states is going to want some sort of security detail. i don't blame them. we don't have the resources for that. lou: we don't have the resources. obviously this is not a coincidence. prosecutors have been assassinated in texas. that is where to put them. that is where the first problem is, whenever it takes. >> and there could be more coming down the road. lou: your judgment. is this aryan brotherhood, the drug cartels or something else? you first. >> i don't think we are ever going to know unless we have other prosecutors and police agencies that willing to take a chance and start arresting people, shooting first and asking questions later which rebel like to do in this country, but this is a heinous crime. >> i don't agree that we're not trying to find out. will they keep it close to the best? absolutely.

the senate will work its way through the process. it already had hearings this year in the judiciary committee on immigration. i don't doubt there will be more. and the way i read the letter was that this bill would have a hearing, not that the issue would be forced to just one hearing. we have not yet seen the bill. we will see l.a. looks. lou: anytime you have legislation cooked up behind closed doors by a small group, a gang of eight, giving a whatever, usually is because it think there are parts of the american public that there will like a loss of the what the protection of closed doors until a to a senate. kendis sounds like obamacare. third out there, give us one hearing and then try to ram it through. be afraid when it is done this way. if they believe these provisions will be popular there would want to be having lots of hearings and be open about the liberation

i think we will see something worse than the 2007 amnesty proposal, worst in the sense that it will be even less serious about the law enforcement side and they don't want the american public to start talking about it. lou: yesterday border patrol agents said the border patrol crossing's had doubled. in some places tripled. this is not a happy piece of timing. >> the fact is that article cited one unnamed source. that is not a data, real data. he looked at the dade, you see that the border apprehensions are lower -- lowest since the 1970's. i would rather look the other one unnamed source. lou: i'm sure that is the case.
